1. Acceptance of terms

By accessing or using the ApeTrust website or engaging ApeTrust for development or hosting services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Description of services

ApeTrust provides SVM (Solana Virtual Machine) and EVM (Ethereum Virtual Machine) software development services, along with custom database hosting and infrastructure management. The specific scope, deliverables, and timeline for any engagement are defined in a separate written agreement or statement of work between ApeTrust and the client.

3. Client responsibilities

Clients are responsible for providing accurate requirements, timely feedback, and any credentials or access needed for ApeTrust to perform the agreed services. ApeTrust is not liable for delays caused by incomplete or delayed information from the client.

4. Intellectual property

Unless otherwise agreed in writing, ownership of code and deliverables produced under a specific engagement transfers to the client upon full payment. ApeTrust retains the right to reuse general-purpose tools, libraries, and know-how developed independently of client-specific business logic.

5. No warranty on-chain

Blockchain software carries inherent risk. While ApeTrust follows industry-standard development practices, we do not guarantee that smart contracts or on-chain programs are free of vulnerabilities. Clients are strongly encouraged to commission an independent security audit before deploying to mainnet.

6. Limitation of liability

To the maximum extent permitted by law, ApeTrust shall not be liable for any indirect, incidental, or consequential damages, including loss of funds, data, or profits, arising from the use of our services or any software we deliver.

7. Termination

Either party may terminate an active engagement in accordance with the terms specified in the applicable statement of work. These Terms of Service continue to govern any surviving obligations after termination.

8. Governing law

These terms are governed by the laws of the jurisdiction specified in the applicable client agreement, without regard to conflict-of-law principles.

9. Changes to these terms

ApeTrust may update these Terms of Service from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
